From the Back Cover

This book offers a clear, accessible account of the American litigation over the restitution of works of art taken from Jewish families during the Holocaust. For the past two decades, the courts of the United States have been an arena of conflict over this issue that has recently captured widespread public attention. In a series of cases, survivors and heirs have come forward to claim artworks in public and private collections around the world, asserting that they were seized by the Nazis or were sold under duress by owners desperate to escape occupied countries. Spanning two continents and three-quarters of a century, the cases confront the courts with complex problems of domestic and international law, clashes among the laws of different jurisdictions, factual uncertainties about the movements of art during and after the war, and the persistent question whether restitution claims have been extinguished by the passage of time.Through individual case studies, the book examines the legal questions these conflicts have raised and the answers the courts have given. From the internationally celebrated “Woman in Gold” lawsuit against Austria to lesser-known claims against Germany, Hungary, Spain, and museums and private collections in the United States, the book synthesizes the legal and evidentiary materials and judicial rulings in each case, creating a coherent narrative of proceedings that are often labyrinthine in complexity. Written by a leading authority on litigation and procedure, the book will be of interest to readers in various fields of the humanities and social sciences as well as law, and to anyone interested in the fate of artworks that have been called the “last prisoners” of the Second World War.

Going into Hay's book, I had an interest in law, but not a terribly good understanding of litigation, and no interest in art. As I read his book, not only did I find the legal aspect incredibly interesting, but I was able to gain a very good understanding of the process of litigation, and learning about provenance research, as well as the history behind several incredibly famous works of art that I otherwise knew nothing about, inspired an interest in art inside me. It is incredibly well written, and is welcoming to those who have a lot of knowledge in this field already, those who are interested in gaining an understanding of the legal process, and those interested in art. As I learned more about the subject, I was able to go back in the book, and I felt as though I could extract even more from passages I had previously read. No matter what your level of familiarity is with law, art, or provenance research, this book will have something to offer you. I highly recommend it as a great book for a personal read, or to be read from an academic standpoint.

Insightful and informative, Bruce L. Hay's "Nazi Looted Art and the Law" is a must-read for those who are interested in or doing research on World War II, international law, and/or the art world. Covering the various works of art that were stolen by the Nazis in World War II (example: Gustav Klimt's "The Lady In Gold"), the book begins by giving a detailed account of where these stolen works of art ended up after the war, and the court cases -- both international and domestic -- surrounding each one. For example, in Chapter 2, the author describes the case of "The United States v. The Portrait of Wally" (a 1912 oil painting by Egon Schiele), and gives a thorough explanation of the story behind how the painting ended up in the Nazis’ hands, how the heirs of the painting finally took their claim to court, the proceedings of the case, the treaty obligations, etc. All in all, I found this book to be interesting, excellently researched, and well-written, and I would recommend it to anyone who is looking to do further research into international law, World War II, or the art world.

If you are interested in learning about litigation over the restitution of artworks seized during the Holocaust, this book is a great choice. The book provides a thorough analysis of various cases, ranging from claims brought against public museums, private collectors, and foreign states. It also includes discussions of some of the more well-known cases (i.e, the "Woman in Gold" lawsuit), and is clear in explaining important legal questions, such as those involving the statute of limitations. Overall, I thought the writing was very clear/easy to follow and a great resource for anyone interested in the subject.

A great resource for those interested in learning about the restitution process of works of art taken during the Nazi era. The author offers an in-depth perspective on several cases, making this an excellent resource for anyone wishing to understand the legal process involving art restitution claims. The book is written in such a way that is very interesting not only to Law students but also to anyone who appreciates learning about historical events related to WWII. Hay's writing is clear and compelling making this book a fine addition to any library - as well as a great year-round gift!
